Privacy Policy

Panther Learning Systems, Inc. (doing business as "Peerceptiv") respects your privacy. This Privacy Policy informs you of our privacy practices, the way your information is collected online, and how that information is used.

1. Scope of this Privacy Policy

This Privacy Policy applies to Peerceptiv's website, domain, and all services, applications, and products (collectively called "Peerceptiv", "Panther Learning", the "Company", or the "Services"), unless superseded by a separate written agreement.

The Services may include links to third-party applications, products, services, or websites for your convenience and information. If you access those links, you will leave the Peerceptiv website. The privacy policy for those websites and services may differ from Peerceptiv's Privacy Policy. Review the privacy policy of any site you interact with before allowing collection and use of your personal information.

Peerceptiv may make changes to this Privacy Policy. Significant changes affecting how the Company uses personal information will be communicated through in-app and/or email notification. Minor changes will be posted on the website. Refer to the Privacy Policy for updates.

2. Collection of personal information

Peerceptiv collects and uses information provided by you to better serve you, personalize your experience, and conduct primary learning objectives of the Services. The company collects names, email addresses, and other data used by your school, institution, or organization to uniquely identify you. If using a Learning Management System (LMS), the institution name and group section membership may be collected as well. The company also collects application usage data, including device type, browser information, IP addresses, session history, keystroke data, cursor changes, time active, and similar browser data.

Some collected information authenticates user accounts. Peerceptiv uses email addresses to communicate with users about pending tasks and updates affecting user experience.

Participation in Peerceptiv Services generates data including:

  1. Projects, assignments, prompts, and rubrics generated by instructors
  2. Learner content, including work products, reviews, and ratings generated in response to instructor prompts
  3. User feedback, ratings, and grades generated by instructors and learners as applicable

Peerceptiv stores certain browser information using cookies—data stored on the user's computer tied to user information.

In some cases, learners and instructors may purchase services directly on the Peerceptiv website using credit card transactions. Peerceptiv uses Stripe as its secure payment gateway service provider. The company does not view, collect, or archive credit card or financial data administrated through Stripe.

3. How we use your information

Information collected by Peerceptiv is shared with learners and instructors for achieving primary educational objectives. Additionally, Peerceptiv may use this information to understand user requirements, deliver consistent and personalized experience, and improve service and support.

All data collected by Peerceptiv is stored within industry-standard AES-256 encrypted databases and log files. Sensitive password data is hashed using modern password hashing. Email is not considered secure communication, and the company does not recommend sending sensitive information by email.

Peerceptiv maintains an archival copy of user data for approximately five years to allow users to establish baseline performance and compare learning outcomes against prior results. If an instructor deletes course data, it is erased entirely from the server.

Peerceptiv may disclose on its website and elsewhere the names of schools, institutions, and organizations using or having used Peerceptiv services.

4. How we share information

Unless specifically described elsewhere in this Privacy Policy, Peerceptiv will not share provided personal information or generated information with third parties, unless to:

  • improve educational outcomes by integrating with learning management systems, publishers, and other educational providers (including Canvas, Blackboard, Brightspace by D2L, and Moodle) as authorized by you or your school, institution, or organization;
  • respond to duly authorized information requests of police and governmental authorities; or
  • investigate and help prevent security threats, fraud, or other malicious activity.

Peerceptiv will not offer goods and services from unrelated third parties and will not sell your data to anyone.

5. FERPA compliance

Peer grading as conducted by Peerceptiv is not considered "sharing" of grades and is permitted under FERPA – Family Education Rights and Privacy Act – regulations (Owasso Independent School District No. I-011 v. Falvo, 534 I.S. 426, 2002).

6. Access

You have the right to access your data and update personal identifying information at any time. You may also delete your data by deleting your account, but check with your school, institution, or organization before materially changing or deleting data. 7. EU-U.S. Data Privacy Framework

Peerceptiv complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Peerceptiv has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles with regard to processing personal data received from the European Union and United Kingdom in reliance on the EU-U.S. DPF and UK Extension. Peerceptiv has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles regarding processing personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between terms in this privacy policy and the DPF Principles, the Principles shall govern. In compliance with the EU-U.S. DPF, UK Extension, and Swiss-U.S. DPF, Peerceptiv commits to resolving DPF Principles-related complaints about collection and use of personal information. EU, UK, and Swiss individuals with inquiries or complaints regarding handling of personal data received in reliance on these frameworks should first contact Peerceptiv at info@peerceptiv.com.

In compliance with these frameworks, Peerceptiv commits to cooperate and comply with advice from the panel established by EU data protection authorities, the UK Information Commissioner's Office (ICO), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) regarding unresolved complaints concerning handling of personal data received in reliance on these frameworks.

Any agreements made with specific organizations that contradict this policy shall take precedent.
